San Andreas State Gang Database (SanGang) Request Board

Welcome to the Los Santos Police Department (LSPD) San Andreas State Gang Database (SanGang) Request Board. In accordance to Street Terrorism Enforcement & Prevention Act (STEP ACT) section 307a and section 309b, this service allows authorized persons to submit requests for status of inclusion in the shared gang database, and requests for removal of their inclusion from the shared gang database.

Note: An adult or juvenile who is designated as a gang affiliate in a shared gang database, the juvenile's parents or guardian, or any attorney working on his or her behalf, may request information from any law enforcement agency regarding a person's inclusion in the shared gang database, as well as his or her designated status as a gang affiliate in the shared gang database. The aforementioned persons are known as authorized persons who can make such a request. They may also request information as to the basis for the designation for the purpose of contesting the designation. Such requests shall be made in writing, via a Request for Status in the Shared Gang Database form.

The SanGang database is used only to identify possible suspects in criminal investigations. It is not used for the purpose of employment checks, housing or welfare benefits, background investigations, or non-criminal immigration proceedings.

Please advise that if an original designation was completed by a Law Enforcement Agency (LEA) other than the Los Santos Police Department, further information may be obtained by contacting the agency making the designation.

Request for Status in the Shared Gang Database
An adult or juvenile who is designated as a gang affiliate in the shared gang database, or the parent or guardian of such a juvenile, or an attorney working on his or her behalf, may request information to any law enforcement agency to determine whether the person has been designated as a suspected gang affiliate in the shared gang database. Such a request is only to be made by the aforementioned authorized person(s).

Request for Removal from the Shared Gang Database
An adult or juvenile who is designated as a gang affiliate in the shared gang database, or the parent or guardian of such a juvenile, or an attorney working on his or her behalf, may request that such a person be removed from the shared gang database. Such a request is only to be made by the aforementioned authorized person(s).

About the SanGang Database

Established in 2020 as a result of the Street Terrorism Enforcement & Prevention Act (STEP ACT), the San Andreas State Gang Database (SanGang) has been created to provide law enforcement agencies with an accurate, timely and electronically-generated database of statewide gang-related intelligence information. All records and information contained in the SanGang database are confidential and are for the use of law enforcement agencies only, as defined in the Street Terrorism Enforcement & Prevention Act (STEP ACT) section 301.

The SanGang system operates pursuant to the United States Code of Federal Regulations, title 28, section 23 (28CFR23), ad seq. as a Criminal Intelligence System.

Who is responsible for the oversight of the SanGang database?

Pursuant to Street Terrorism Enforcement & Prevention Act (STEP ACT) section 302 and 303, the Los Santos Police Department is responsible for maintenance of the SanGang Database, whilst management falls under a panel composed of the Commanding Officer(s) of the participating law enforcement agencies investigative elements.

Who has access to the SanGang database?

The SanGang database is not available to all law enforcement agencies or personnel. Only approved and trained law enforcement officers and support staff may access SanGang information. Access and release of SanGang Criminal Intelligence Information is on a Right-to-Know (A Law Enforcement Officer and Support Staff) and Need-to-Know (Legitimate Law Enforcement Purpose) basis only.

There are circumstances where approved users may run proxy queries on behalf of other users who demonstrate a need-to-know and right-to-know, but there are restrictions on the number of times this may occur in a given year.

Where can I find the most recent version of the regulations?

Can the information in the SanGang database be used for immigration purposes?

Records contained in the SanGang database are not disclosed or released for the purposes of enforcing federal immigration law, unless required by San Andreas state or federal statute or regulation.

In addition, information contained in the SanGang database is not disclosed or released under any of the following circumstances:

- For employment, housing, or military screening purposes.
- For non-criminal internal affairs investigations.
- To the members of the general public or media.
- To another person who does not have a Right-to-Know and Need-to-Know.
- In any official reports.

How are subjets added into the SanGang database?

A suspected gang affiliate may initially be entered into the SanGang database and designated as a gang affiliate if a minimum of two unique criteria* are found to exist through investigation by a trained law enforcement officer, and not without a law enforcement agency’s reasonable suspicion, provided the gang’s existence has been, or is concurrently, documented in the database.

All criteria must be supported by lawfully obtained source documents. Examples of source documents may include, but are not limited to, arrest reports, field interview cards, photographs, and jail records.

All proposed entries made in SanGang, and related intelligence data, must be reviewed and approved through a supervisory review process.

How can I find out if I am in the database?

You, or an attorney working on your behalf, may submit a written request to any local law enforcement agency to determine if you are listed in the SanGang database.

The law enforcement agency will provide details regarding whether you are designated in SanGang and the name of the law enforcement agency that made the designation. If you are a juvenile person under 18 years of age, your parent or guardian or an attorney working on your behalf may submit a written request.

Please note, if responding to an information request from either an adult or a juvenile would compromise an active investigation or the health and safety of a juvenile who is designated as a Gang Affiliate in the SanGang database, the law enforcement agency that received the request is not required to provide a response.

If I am in the SanGang database, how can I be removed?

If you, your parent or guardian if you are a juvenile, or an attorney working on your behalf, have received written notice from a law enforcement agency that you are designated in the SanGang database, you, your parent or guardian if you are a juvenile, or your attorney, may submit a written request to contest your designation in SanGang. This written request must be submitted to the appropriate (designating) law enforcement agency.

Please note, the local law enforcement agency will provide a written response within 30 days of the submission of your request for removal. If the law enforcement agency denies your request for removal, their response will include the reason for the denial. If the law enforcement agency does not provide a response within a 30-day period, the request for removal from SanGang should be considered denied.

My request for removal has been denied by the law enforcement agency, what are my subsequent options?

Any person who has contested their inclusion into the SanGang database and was denied request to be removed by the law enforcement agency, may file a petition with the Los Santos County District Attorney's Office to review the law enforcement agency’s denial of their request and to remove the person from SanGang if found to not be in accordance with the STEP Act.

Alternatively, any person who has contested their inclusion into the SanGang database and was denied request to be removed by the law enforcement agency, may file a petition with the superior court to review the law enforcement agency’s denial of their request and to order the law enforcement agency to remove the person from SanGang.

**If the law enforcement agency does not provide a verification of the agency’s decision within the required 30-day period, the request to remove the person from the gang database shall be deemed denied. You may file a petition with the Los Santos County District Attorney's Office to review the law enforcement agency’s denial of their request and to remove the person from SanGang if found to not be in accordance with the STEP Act.

The petition may be brought by the person, by their parent or guardian if the person is a juvenile, or an attorney on behalf of the person, parent or guardian.

How long will I remain in the SanGang database?

The record of a person designated in the SanGang database will be retained until the inclusion to the database has been appealed successfully, or the subject ruled to not be a designated gang affiliate by courts.
